TERMS & CONDITIONS
Liability
Whilst we make every effort to safeguard participants, EMAC cannot be held liable for any damage, injury, or loss of any kind caused by or resulting from any act or omission by its employees, agents or contractors. EMAC also assumes no responsibility for any act of negligence, act or omission whatsoever by any company whose services are used as part of package provided including but not limited to activity and accommodation providers. EMAC herein gives notice that we cannot be responsible for any disruption of travel and/or unrest, labor problems, mechanical or construction difficulties, climatic aberrations, acts of God, war, diseases, or any other circumstances beyond our control. We are not responsible for the neglect or omission of partners or suppliers. EMAC reserves the right to refuse service to any individual for any reason.
Safety & Discipline
Safety of each and every member of the group is our top most priority. Each participant is expected to fully comply with the instructions provided, understand and sign the “Assumption of Risks” & Disclaimer/Release form.
Release form
While we make every effort to safeguard our clients, we cannot be held responsible for personal injury or loss due to events beyond our control. Adventure sports carry a higher than normal risk and a signed release form is mandatory from all participants before tour departure.
Agenda
EMAC will strive to achieve a sigh-off on an agreed agenda, at least 15 working days prior to the expedition.
Transportation
EMAC may provide appropriate transportation service for participants as per agreed terms and costs. EMAC utilizes its suppliers for reliable, out-sourced transport services throughout Pakistan and invoices the actual cost, which includes fuel and drivers expenses.
Lodging
Apart from a completely private and remote lake-side camping facility, EMAC owns and/or operates 2 properties,
a) A spacious 8 bedroom hilltop mansion near Islamabad, and
b) A beautiful lake-side house with 2 bedrooms + large hall and gardens, as its official Club Houses. During over-night stays, participants may be required to share the rooms with up to 5 other participants depending on the group size. EMAC may also assist in acquiring outsourced lodging facilities like Hotels/Motels and Guesthouses as per clients requirements.
Meals & Refreshments
EMAC may as per agenda, provide healthy and fresh meals and preparation facility for all members of the group. These can be on Club House cooked, catered or self cooked basis. EMAC will not be held responsible for any standard of service provided by outsourced caterers/restaurants.
Out-Sourced Services
EMAC is an adventure agency acting as an intermediary or agent for suppliers, such as carriers, hotels, tour operators, ground transportation companies, catering and other independent firms. EMAC does not own or operate any of these firms specifically marked “Out-Sourced”; therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers or service providers, which result in any loss, damage, delay or injury to any participant. In addition, EMAC cannot guarantee acceptable performance by any of these firms, or service providers, and each participant agrees not to hold EMAC liable for the quality of services and the condition or cleanliness of the accommodations arranged. Unless the term “guaranteed” is specifically stated in writing on your invoice or reservation itinerary/agenda, we do not guarantee any of such suppliers’ rates, bookings, services or reservations. Your retention of reservations or bookings after issuance shall constitute your consent of the above, and an agreement on your part to convey the contents hereto to your group members.
Club equipment and property
The participants are solely responsible for any loss or damage to the properties and equipment belonging to the club, its partners or suppliers, resulting from any rowdy or irresponsible behavior and not following safety instructions, and the subsequent replacement, or complete reimbursement of the cost of the damage or loss. Late reimbursements and/or replacements may incur further monitory penalties to cover loss of business.
Invoicing & Payments
EMAC requires an official Purchase Order (PO) for the planned event, along with 100% advance payment, at least 15 days prior to the event date. All rates quoted are exclusive of government taxes. Payments can be made through company cheque, direct deposit or cash.
Cancellations
Cancellation of a booking or part thereof will incur the following fees.
5 Days – 30 Days: 25% of the total invoice amount
24 Hours – 48 Hours: 50% of the total invoice amount
Within 24 Hours: 100% of the total invoice amount
Media
EMAC reserves ownership rights to the photographs and videos taken by the club during the event and may be used for marketing purposes on publications to our website and in print advertising. Please see our “Privacy Policy” for more information.
